Product Liability

Haslam and Gallagher has successfully represented clients seriously injured by dangerous products against manufactures in product liability lawsuits.  Our firm has a solid history of protecting folks from harmful or dangerous products.

We are proud of the changes we have brought to big industry. After successfully prosecuting several eye injury cases for exploding Yoo-Hoo bottles, we were instrumental in Yoo-Hoo changing their bottle caps from screw top lids to pop off lids. Now, when you purchase Yoo-Hoo drinks, the cap is easily removable. Customers are safer because of this litigation.

We are currently working on defective hip implant cases including Depuy and Apex.

Our product Liability Cases Include:

  • Flammable sound proof foam: Children burned by polyurethane foam that lacked flame retardant, $1 million and a confidential settlement amount from the manufacturer
  • Garnett Machinery (Cotton): Arm amputation from inadequate safety fence, $1.4 million
  • Hammerblow Trailer Hitch: Defective spring in action of the collar caused detachment of trailer from the vehicle. $2 million verdict, affirmed on appeal. We have prosecuted additional cases to confidential settlements
  • Pavement Saw: Failure to follow ANSI standards in the design and manufacturing of the saw – confidential settlement
  • Yoo-Hoo Chocolate Beverage Drinks: Several confidential settlements for eye injuries from exploding bottles
  • GM: defective door latch resulting in passenger ejection
  • GM Suburban rollover: defective roof and seat design
  • GM: failure to incorporate an airbag in automobiles
  • Several defective saws cases resulting in hand injuries
  • Severe burns resulting from defective insulation
  • Robert Haslam filed the first Vioxx case in Tarrant County

The area of product liability has become far more complicated recently since Texas passed “tort reform” measures to protect the manufactures and distributors of defective products in Texas. Settlement credits, medical subrogation claims, third party liability, and limitations on evidence further handicap the injured looking for justice.

We feel strongly that consumer rights should be protected. We will be glad to visit with you about your injury or potential product liability case.
